Description:
The Missile Defense Agency (MDA) intends to solicit, negotiate and award a sole source contract to deciBel Research, Inc. for Modeling and Simulation Vistas Core Truth Models (MSV-CTM). MSV-CTM is the follow-on for the Modeling and Simulation Contract for Truth Models and Element Representations (MASC-T). The statutory authority for this is Revolutionary FAR Overhaul (RFO) 6.103-5(b)(1), agencies may contract without providing for full and open competition when expressly authorized or required by statute. Section 874 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2022 and Section 872 of the NDAA for FY 2024 authorize the establishment of a pilot program to incentivize contracting with employee-owned businesses.
The U.S. DoW published a final rule to amend the Defense Federal Acquisition Regulation Supplement to implement Section 874 of the National Defense Authorization Act (NDAA) for FY 2022 as amended by Section 872 of the NDAA for FY 2024. The final rule allows the noncompetitive award for certain follow-on contracts to a wholly employee-owned business through an employee stock ownership plan (ESOP) that meets the definition of a “qualified business.” Section 874 as amended defines a “qualified business” as an S corporation (as defined in section 1361(a)(1) of the Internal Revenue Code of 1986) for which 100 percent of the outstanding stock is held through an employee stock ownership plan as defined in section 4975(e)(7) of such code.
This notice is not a request for competitive proposals. Any information received as a result of this notice will be considered solely for enhancing competition in future competitive procurements.
The Government will not pay for information submitted. Questions may be directed to mda.redstone.dea.mbx.msv-ctm@mail.mil
